NextGen Inclusive owns All In, an online platform that serves caregivers of persons with special needs. Services include developmental screening tools, information in the form of articles, infographics, videos and other mediums, an e-commerce website, a course listing and/ or booking portal, a tracker for milestones and activities, etc.

If you use the All In website or any of our applications on any platform, or if you use any of NextGen Inclusive’s services whether directly or indirectly online, through a mobile device, by email or telephone or in person, including reviewing, commenting, making bookings or reservations, you acknowledge and agree that you have read, understood and agreed to be bound by these Terms of Use.

 

A. General

  1. All In is owned, operated and provided by NextGen Inclusive Pte Ltd (“NextGen Inclusive”) and the pages, content and infrastructure of these pages are provided for your personal non-commercial use only. Therefore, you are not allowed to re-sell, deep-link, use, copy, monitor (e.g. spider, scrape), display, download or reproduce any content or information, software, products or services available on our website for any commercial or competitive activity or purpose.

  2. All In seeks to provide helpful and accurate information services via our developmental screening tools, information in the form of articles, infographics, videos and other mediums, but we make no endorsement, representation, or warranty of any kind about any content, information or services. The information services do not constitute medical advice, diagnosis or treatment. You should always talk to a qualified medical professional about any questions you may have about a medical condition. In the event of a medical emergency, you should call your doctor or the emergency services immediately. Any decision made affecting health and treatments selected should always be made in consultation with a doctor, and not on the basis of the information or tools provided on All In. While every care has been taken to ensure accuracy of the information, NextGen Inclusive expressly disclaims all liability for any errors.

  3. You may choose to browse the All In platform as a guest, or enjoy advanced features of the platform by logging in as a Member. Either way, services on All In are provided free of charge for you unless specifically stated otherwise. We will not charge you any additional booking fee to the stated transaction amount when you use our e-commerce or activity booking services. Some of our e-commerce and activity providers (“Providers”) pay us a small commission for our role in facilitating the transaction.

  4. By making a reservation or purchase on All In, you enter into a direct and legally binding relationship with the Providers with which you have reserved or purchased from. All In acts solely as an intermediary between you and the Provider, transmitting the details of the reservation or purchase, sending confirmatory emails on behalf of the Provider and, in some cases processing payment and carrying out other incidental tasks to process the transaction. All reservations and/ or purchases are subject to the Standard Term and Conditions (between Provider and User). In addition, the Provider may have further terms and conditions which they will upload to the website. You are advised to read these in detail before making your booking.

  5. By making the reservation or purchase, you are bound by the Provider’s terms, including those of cancellation, re-scheduling and refund. In the absence of any specific terms by the Provider, there shall be no refund given by the Provider, or rescheduling allowed, in any circumstances. Where rescheduling or refunds are allowed by the Provider’s terms, this shall be a matter for you and the Provider to resolve directly, and All In shall not be liable for any further support or refund.

  6. If you engage in any treatment, therapy or Service, or if you purchase any Product that you learnt about or purchased through All In, you agree that you are voluntarily engaging with these, and do so at your own risk.

  7. Where the booking or reservation is made pursuant to a Best Price Guarantee, you are protected by our Best Price Guarantee Policy.

  8. When you make payment through All In, this payment is safely processed by means of secure online payment, to the extent offered and supported by your bank. All In shall not be responsible for withholding tax, or for any tax payment of whatsoever nature which you or the Provider are legally bound to pay.

  9. By completing a reservation or purchase, you agree to receive (a) emails which All In may send you in relation to your reservation or purchase, giving you information on your reservation or purchase and providing you with certain information and offers (including third party offers to the extent that you have actively opted in for this information) relevant to your interests and your past transactions, and (b) emails which we may send to you promptly after you have received the purchased product or participated in the courses, inviting you to complete our review form.

  10. NextGen Inclusive respects your privacy. Please see our Privacy and Cookies Policy for more information about how we may contact each other.

  11. All information provided on the e-commerce store or in the activities booking section on the All In platform or disclosed by NextGen Inclusive through any other means are based on the information provided by our Providers. These Providers are given access to a system through which they are fully responsible for updating all details of their products or services, including rates, availability and other information. NextGen Inclusive will use reasonable skill and care in performing our services, however we will not verify if, and cannot guarantee that, all information is accurate, complete or correct, nor can we be held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any temporary and/ or partial breakdown, repair, upgrade or maintenance of the All In platform or otherwise), inaccurate, misleading or untrue information or non-delivery of information. Each Provider remains responsible at all times for the accuracy, completeness and correctness of the information displayed on All In. Unless specifically stated, nothing on the All In platform constitutes and should be regarded as a recommendation or endorsement of the quality, service level, qualification or rating or any Provider or their products or services.

  12. Obvious errors and mistakes (including misprints) are not binding.

  13. You must be a Member to review and rate Providers and/ or their Products or Services. If you choose to do so, you agree to be bound by All In’s Review, Ratings and Ranking Policy.

  14. The All In Tracker provides a convenient way for you to keep track of milestones and daily activities. Content you upload on the All In Tracker can only be viewed by you and persons you give consent to. NextGen Inclusive shall not publish any text or photos you upload on the All In Tracker, unless we have first obtained your written consent. Paragraph 15 shall apply in respect of your warranties as to copyright, your legal and moral responsibility relating to all uploads you make, and our right to remove or delete any inappropriate content.

  15. By uploading text and photos/images onto All In (except in the case of the All In Tracker), you certify, warrant and agree that you own the copyright to the photos/images and that you agree that NextGen Inclusive may use the uploaded text and photos/images on our (mobile) website and app, and in (online/offline) promotional materials and publications and as NextGen Inclusive at its discretion sees fit. You are granting NextGen Inclusive a non-exclusive, worldwide, irrevocable, unconditional, perpetual right and license to use, reproduce, display, have reproduced, distribute, sublicense, communicate and make available the photos/images as NextGen Inclusive at its discretion sees fit. By uploading these photos/images, you accept full legal and moral responsibility of any and all legal claims that are made by any third parties (including, but not limited to, Providers) due to NextGen Inclusive publishing and using these text and photos/images. NextGen Inclusive does not own or endorse the photos/images that are uploaded. The truthfulness, validity and right to use of all photos/images is assumed by the person who uploaded the photo, and is not the responsibility of NextGen Inclusive. NextGen Inclusive disclaims all responsibility and liability for the pictures posted. By posting the text and photos/ images, you warrant that these shall not contain any viruses, Trojan horses or infected files and shall not contain any pornographic, illegal, obscene, insulting, objectionable or inappropriate material and does not infringe any third party (intellectual property right, copyright or privacy) rights. Any text and photo/image that does not meet the aforesaid criteria will not be posted and/or can be removed/deleted by NextGen Inclusive at any time and without prior notice.

  16. Subject to the limitations set out in these terms and conditions and to the extent permitted by law, we shall only be liable for direct damages actually suffered, paid or incurred by you due to an attributable shortcoming of our obligations in respect to our services, up to an aggregate amount of the aggregate cost of any payment you have made to us in that transaction, as set out in the confirmation email (whether for one event or series of connected events). However and to the extent permitted by law, neither we nor any of our officers, directors, employees, representatives, subsidiaries, affiliated companies, distributors, affiliate (distribution) partners, licensees, agents or others involved in creating, sponsoring, promoting, or otherwise making available the site and its contents shall be liable for (i) any punitive, special, indirect or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, loss of claim, (ii) any inaccuracy relating to the (descriptive) information (including rates, availability and ratings) of the Provider as made available on our website, (iii) the services rendered or the products offered by the Provider or other business partners, (iv) any (direct, indirect, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, pursuant to, arising out of or in connection with the use, inability to use or delay of our website, or (v) any (personal) injury, death, property damage, or other (direct, indirect, special, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, whether due to (legal) acts, errors, breaches, (gross) negligence, willful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by or (wholly or partly) attributable to the Provider or any of our other business partners (including any of their employees, directors, officers, agents, representatives or affiliated companies) whose products or service are (directly or indirectly) made available, offered or promoted on or through the website, including any (partial) cancellation, overbooking, strike, force majeure or any other event beyond our control.

  17. Unless stated otherwise, the software required for NextGen Inclusive’s services or available on All In and the intellectual property rights (including the copyrights) of the contents and information of and material on All In are owned by NextGen Inclusive, its suppliers or Providers. NextGen Inclusive exclusively retains ownership of all rights, title and interest in and to (all intellectual property rights of) (the look and feel (including infrastructure) of) the website on which the service is made available (including the guest reviews and translated content) and you are not entitled to copy, scrape, (hyper-/deep)link to, publish, promote, market, integrate, utilize, combine or otherwise use the content (including any translations thereof and the guest reviews) or our brand without our express written permission. To the extent that you would (wholly or partly) use or combine our (translated) content (including guest reviews) or would otherwise own any intellectual property rights in the website or any (translated) content or guest reviews, you hereby assign, transfer and set over all such intellectual property rights to NextGen Inclusive. Any unlawful use or any of the aforementioned actions or behaviour will constitute a material infringement of our intellectual property rights (including copyright and database right).

  18. If you submit comments, ideas or feedback to us, you agree that we can use, disclose, reproduce, distribute and exploit them without any restriction or compensation to you. We do not waive any rights to use similar or related ideas or feedback previously known to us, or developed by us or obtained from sources other than you.

  19. All In may display or permit linking or other access to or use of third-party content, promotions, websites, apps, services and resources (collectively, “Third Party Services”) that are not under our control. We provide these links only as a convenience and are not responsible for the products, services or other content that are available from Third Party Services. You acknowledge that any Third-Party Services that you use in connection with or assessed from the All In platform are not part of the All In platform and are not controlled by NextGen Inclusive, and you take sole responsibility and assume all risk arising from your interaction with or use of any Third Party Service. You also acknowledge that these Terms and our Privacy Policy do not apply to any Third Party Services. You are responsible for reading and understanding the terms and conditions, and privacy policy, that applies to your use of any Third-Party Services.

  20. All In may change or discontinue, temporarily or permanently, any feature, component, or content at any time without notice. We will not be liable to you or to any third party for any modification, suspension, or discontinuance of any feature, component, or content of any of our Services. We reserve the right to determine the timing and content of software updates, which may be automatically downloaded and installed without prior notice to you.

  21. We reserve the right to suspend, deactivate or terminate your account or your access to certain aspects or all of the Services, or to modify these Terms of use, at our sole discretion, at any time and without notice or liability to you. Upon any such suspension, deactivation, or termination, we may delete or remove your content and other information related to your account. You may close your account at any time by contacting Customer Support.

  22. To the extent permitted by law, these terms and conditions and the provision of our services shall be governed by and construed in accordance with Singapore law and any dispute arising out of these general terms and conditions and our services shall exclusively be submitted to the competent courts in Singapore.

  23. If any provision of these terms and conditions is or becomes invalid, unenforceable or non-binding, you shall remain bound by all other provisions hereof. In such event, such invalid provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and you will at least agree to accept a similar effect as the invalid, unenforceable or non-binding provision, given the contents and purpose of these terms and conditions.

 

B. Standard Booking Term and Conditions (between Provider and User)

  1. Any Listing by a Provider which can be booked on All In constitutes an offer, and a fully paid up booking constitutes acceptance of that offer. The booking is a direct agreement between the Provider and the User, and NextGen Inclusive is not a party.

  2. The booking is subject to the cancellation/ refund policy of the Provider providing the Product or Service. In any event, parties agree that any fee received by NextGen Inclusive is non-refundable.

  3. For Services, the booking is subject to the rescheduling policy of the Provider. The All In platform may in some cases support rescheduling but parties agree that NextGen Inclusive shall not be liable for any acts or omissions relating to such rescheduling support.

  4. Where the Listing is stated to be a Best Price Guarantee Listing, this means that the prices offered by the Provider is lower or equal to what the Provider offers anywhere else, including if the Member purchases directly from the Provider.

  5. If any User is able to show that the Provider has offered a lower price through another channel other than on the All In platform, the Provider shall refund to NextGen Inclusive the price difference, and if NextGen Inclusive receives this refund, it shall return the same to the User. The User also has the right to seek the difference back from the Provider directly.

  6. Where the User makes a reservation on the All In platform, the Provider must hold the Product or Service in accordance to the agreed terms and conditions of the reservation, or for 2 working days. If the User does not make payment in cash at the Provider’s premises (or by any other means mutually agreed as between parties), the reservation shall be deemed to be released.

 

C. Review, Ratings and Ranking Policy

  1. Reviews and Ratings by Members are for the primary purpose of informing other Members and future customers of the Member’s opinions of the service level and quality of the Providers’ Services or Products, and their general impression of the Providers. Reviews may also be used at All In’s sole discretion for marketing, promotion or improvement on NextGen Inclusive’s Services or Products, on any of its websites, including the All In booking platform, or such social media platforms, newsletters, special promotions, apps or other channels owned, hosted, used or controlled by All In.

  2. Only Members are allowed to review and rate Providers.

  3. Members may review and rate Providers which they or their children have had interactions with, whether or not such interactions took place as a result of booking on the All In platform.

  4. If the Provider is of the view that a review or rating has been done by a Member which has not in fact had that interaction with it, the Provider shall as soon as practicable inform All In of the same, with as much detail and supporting evidence to back up their position.

  5. All In reserves the right to adjust, refuse or remove reviews at its sole discretion. Where applicable, and at its sole discretion, All In may also upload the Provider’s comments in relation to any review on the All In website.

  6. To facilitate Members’ ease of finding a suitable Product or Service, All In may rank Providers, and/ or Listings of Products and Services. Ranking is done through a fully automated ranking system (algorithm) and is based on multiple criteria. Depending on the category criteria, ranking is based on different themes and criteria from time to time.
